Article VII — Architectural Control Committee
Clause VII.A — Membership
The Architectural Control Committee (ACC) shall consist of three members elected by the Board of Directors to staggered three-year terms. A majority of the Committee may designate a representative to act on its behalf. Vacancies shall be filled by the Board.

🟡 Will conflict as of 2028. The ACC is appointed entirely by the Board, not elected by members. Under WUCIOA, at least two-thirds of total director positions must be elected — no more than one-third may be appointed. If the ACC is treated as equivalent to or derivative of the board structure, full board appointment of the committee will conflict with this requirement. The restatement should address whether the ACC is a board committee (governed by director appointment limits) or a separate member-elected body.
Clause VII.B — Procedure
All approvals and disapprovals must be in writing and signed by at least two Committee members. An owner whose application is disapproved may appeal to the Board in writing within 10 days. The Board shall consider the appeal at its next scheduled meeting and issue a final determination within 15 days after that meeting. If the Committee fails to approve or disapprove an application within 30 days of submission, or if no legal action is commenced before construction is completed, approval is deemed granted and the structure is deemed in compliance.

Article VIII — Further Dedications & Restrictions
Clause VIII.A — Dedications
Ken Lake Development Co., Inc. has dedicated to the common use and enjoyment of all Lakemoor lot owners the portion of the Ken Lake bed lying below the extreme low water line and the surface of Ken Lake, subject to the restrictions in Clause VIII.B.

Flag Ken Lake Development Co., Inc. is named as the grantor of the lake bed dedication (VIII.A). Verify this entity's current legal status and whether the dedication remains in effect under current title. Also: the lot-specific dock prohibition (lots 50/59) should be cross-referenced to the current plat to confirm lot numbers are still accurate after any replats.
Clause VIII.B — Restrictions on Lake Use
All lot lines abutting Ken Lake are limited to the extreme low water line. No restrictions or projections may be placed on the lake bed below extreme low water except in front of community recreation areas and as follows:
a. All development, activities, and construction on or adjacent to Ken Lake must comply with the Thurston Regional Shoreline Master Program and applicable Olympia Municipal Code.
b. No boathouses are permitted on docks or the lake bed.
c. Docks are permitted to a maximum length of 30 feet from ordinary low water (or 50 feet from ordinary high water, whichever is greater), at a right angle to the bank. No docks adjacent to Lots 50 or 59 (Division 1) except within 6 feet on each side of the common lot line.
d. Docks on dredged canals are limited to 2 feet beyond ordinary low water. Lots 82–86, 67–72, 46–48, 33–35, and the south half of Lot 32 (Division 1) are deemed to abut dredged canals.
e. All docks and floats require ACC-approved plans and shall be constructed to minimize impact on lake aesthetics and environmental health.
f. Floats may be anchored over the lake bed in front of or adjacent to non-dredged-canal lots (other than Lots 50, 59, SE half of Lot 60, and W third of Lot 49 in Division 1) up to a maximum of 70 feet from ordinary low water.
g. The Lakemoor Community Club shall maintain community floats adjacent to waterfront parks for the recreational use of all residents.

Clause VIII.C — Boat Restrictions
No motorboats shall be operated or permitted on Ken Lake.

Clause VIII.D — Lake Health Management
Residents shall manage their lots and household activities to maintain optimal Ken Lake health. The Board shall manage community properties to the same standard. All owners shall give careful consideration to the lake impact of fertilizers, moss treatments, vehicle and home washing chemicals, other chemical use, and the management of residential and community drainage systems.

Clause VIII.E — Further Restrictions on Use
The general plan envisions Lakemoor as an integral residential unit surrounding Ken Lake without breaks or through-traffic. No sewer or water lines may be extended across any lot to serve areas beyond the Lakemoor perimeter without written consent of the Lakemoor Community Club. No lot may be used or dedicated as a street or public way providing access to areas outside Lakemoor Divisions 1 through 5.
