Article VIII — Conflict with Declaration or Law

These Bylaws are intended to comply with and supplement the requirements of the Act and the Declaration. If any of these Bylaws conflict with the provisions of the Act or the Declaration, the provisions of the Act and Declaration will apply.

Committee Notes

The governing document hierarchy is: State law (Act) > Declaration > Bylaws > Board Rules. This article codifies that hierarchy and ensures no bylaw provision can inadvertently override the Declaration or applicable Washington law. We also have Articles of Amendment, which is the corporate filing of the Lakemoor Community Club.


The committee recommends a final legal review of the full bylaws document against the Declaration and current RCW to identify and resolve any conflicts before adoption. This article is under active review.
